A control mechanism can ensure that the material that institutions include in their repositories is included legally and complies with the relevant legislation. It is impossible, however, to entirely prevent any problems that may lead to complaints. Nevertheless, an institution can minimise the risk by formulating, implementing, and publicising policy and procedures regarding the “Notice and Takedown” procedure.

In order to assist institutions with drawing up the relevant policy and with the resulting procedures, SURF – in collaboration with the JISC’s JORUM project – has produced a model “Notice and Takedown” procedure. The model procedures can be adapted to the situation at a particular institution. A checklist of questions has also been drawn up; this also refers to potential legal issues such as the infringement of copyright and other intellectual property rights.

The model is particularly useful for those in charge of institutional repositories and their staff, and the staff of higher education institutions who are responsible for compliance with the applicable regulations.
